Overview
Sharda School of Law is organising a Guest Lecture on the Bail Jurisprudence and statutory provisions including Anticipatory bail-an empirical perspective. Personal Liberty is one of the most valuable fundamental right given under the Constitution. The object of the arrest and detention of the accused is primarily to secure his appearance at the time of trial and to ensure that in case he is found guilty he is available to receive the sentence. If his presence at the trial could be reasonably ensured otherwise than by his arrest and detention, it would be unjust and unfair to deprive him of his liberty during the pendency of the criminal proceeding against him.
The law of bail “has to dovetail two conflicting demands, namely on one hand, the requirement of the society for being shielded from the hazards of being exposed to the misadventures of accused person; and on the other, fundamental canon of criminal jurisprudence viz. presumption of innocence of the accused till he is found guilty.” Bail is recognition of this ‘presumption of innocence’. It is blends the two apparently conflicting claims- the freedom of the individual and the interest of justice. The provisions of bail restore the liberty of the arrested person without jeopardizing the objectives of arrest. Therefore, the general rule is “bail not jail”.
Objectives of Event
- Understanding the concept of Bail, specifically anticipatory bail : To gain a deep understanding of the procedural steps involved in filing of regular bail/ Anticipatory Bail application, including requirements, timeframes, and court protocols.
- Procedural Insights about the bail: To analyze the procedural aspects of filing and arguing, defending and contesting bail applications. Nature and effects of the conditions which the court may impose.
- Advocacy Skills Development: To train students how to present compelling arguments, in defending and contesting the bail applications.
